This Privacy Policy (“Policy”) describes how MPAC (“Marketplace Owner”), together with MPAC (“Connector”) and Solution Provider participants (“Solution Provider(s)”), collects, uses, shares, sells, licenses, discloses, stores, analyzes, and otherwise processes information relating to any individual or entity who accesses, browses, submits information through, or otherwise uses the marketplace, related websites, landing pages, forms, advertisements, communications, and services (collectively, the “Platform”).

For purposes of this Policy, “you” and “your” refer to any individual or entity. “We,” “us,” and “our” refer to Marketplace Owner, Connector and, where the context permits or applicable law allows, also include one or more Solution Providers, affiliates, subsidiaries, successors, assigns, service providers, contractors, marketing partners, analytics partners, data partners, and other persons or entities involved in the operation, promotion, monetization, administration, or fulfillment of the Platform or any request initiated through it.

1. Scope and Relationship Among Stakeholders

The Platform is a marketplace environment through which:

  1. Marketplace Owner owns, operates, administers, monetizes, and controls the Platform;
  2. Connector may advertise, promote, introduce, refer, direct traffic or prospective customers to the Platform or to specific offerings on the Platform, and may independently market to, monetize, and further distribute leads and data as permitted by this Policy and applicable law;
  3. Solution Providers may receive leads, inquiries, applications, submissions, data, and other communications from or about you through the Platform; and
  4. Visitors may browse the Platform, request information, compare offerings, or submit data in connection with one or more products, services, offers, consultations, or opportunities.

By using the Platform or submitting information through it, you acknowledge that your information may be collected by one stakeholder, multiple stakeholders, or all stakeholders involved in your interaction, and may be independently used by Marketplace Owner, Connector, and Solution Providers as permitted by this Policy, their own applicable terms, and applicable law.

2. Connector Override and Substituted Policies

If a Connector presents, links to, displays, or otherwise makes available its own privacy policy and/or terms and conditions in connection with your interaction, lead form, landing page, referral path, advertisement, co-branded page, microsite, communication, or other point of engagement, then, to the maximum extent permitted by law:

  1. that policy and/or terms shall govern and fully replace this default Policy and any default visitor-facing marketplace terms solely with respect to: (i) your relationship with Connector; (ii) Connector’s collection, use, disclosure, sale, sharing, retention, and other processing of your data; and (iii) your use of the applicable Connector-controlled experience; and
  2. this default Policy shall continue to apply to Marketplace Owner, Solution Providers, and any other stakeholder not expressly displaced by such connector-specific terms.

Where both this Policy and a connector-specific policy could apply, they shall be construed cumulatively to the broadest extent permitted by law in favor of permitted processing, except to the extent a connector-specific policy expressly states it supersedes this Policy for a specific subject matter.

3. Information We Collect

We may collect, receive, infer, append, verify, enrich, or generate the following categories of information about you, whether directly from you, indirectly, automatically, from other stakeholders, or from third parties:

3.1 Identifiers and contact data
Name, alias, username, postal address, email address, telephone number, mobile number, social media handle, online identifier, IP address, device identifiers, cookie IDs, advertising IDs, unique personal identifiers, account credentials, and signatures.

3.2 Demographic and profile data
Age range, date of birth, household information, marital status, protected-class information where voluntarily provided or otherwise lawfully obtained, language preferences, veteran status, disability-related information where lawfully processed, and other profile characteristics.

3.3 Commercial, transactional, and inquiry data
Products or services viewed, selected, requested, compared, purchased, financed, applied for, or inquired about; request history; lead source; referral source; communications regarding products or services; and records of transactions or prospective transactions.

3.4 Professional and business information
Employer, industry, business name, business contact information, job title, role, ownership information, size of business, operational data, and other business-related information.

3.5 Financial and eligibility-related information
Income ranges, asset information, debt information, business revenue, tax-related information, stated needs, self-reported qualifications, application data, and other information relevant to evaluating interest, eligibility, suitability, or matching. We may also receive or generate scores, rankings, probability models, and other inferences based on such information.

3.6 Sensitive data
To the extent lawfully collected and permitted, we may collect sensitive personal information or other special-category data that you provide, authorize, or direct others to provide, including government identifiers, precise geolocation, account credentials, financial account data, information relevant to fraud prevention or identity verification, and other data you choose to submit. We do not use such data beyond what applicable law allows, but you acknowledge such data may be processed where reasonably necessary for operational, security, legal, compliance, verification, matching, marketing-suppression, or transaction-enablement purposes.

3.7 Internet and device activity
Browser type, operating system, device characteristics, session activity, clicks, page views, scrolls, referral URLs, search terms, ad interactions, timestamps, approximate geolocation, network information, pixel events, cookies, SDK events, and similar usage data.

3.8 Communications and content
Call recordings, SMS/MMS messages, emails, chat transcripts, form submissions, support requests, survey responses, reviews, testimonials, uploaded files, documents, and any other content you send to us or through the Platform.

3.9 Third-party and derived data
We may receive data from affiliates, Connector, Solution Providers, public sources, social networks, ad networks, data licensors, analytics vendors, fraud vendors, identity vendors, lead vendors, CRM systems, payment processors, and other lawful sources. We may combine data from all sources and create new data, segments, audiences, or profiles derived from that information.

4. How We Collect Information

We collect information:

  1. when you browse, use, or interact with the Platform;
  2. when you fill out forms, request quotes, ask for contact, click ads, schedule consultations, apply, subscribe, register, upload materials, or communicate with us;
  3. when a Connector refers or introduces you;
  4. when a Solution Provider receives, updates, or returns information about you;
  5. through cookies, pixels, tags, SDKs, session replay tools, APIs, web beacons, and similar technologies;
  6. from service providers, affiliates, and marketing partners;
  7. from public records, commercially available sources, and data licensors; and
  8. from other sources where permitted by law.

5. Cookies, Tracking, and Advertising Technologies

We and our partners may use cookies and similar technologies for authentication, fraud prevention, analytics, attribution, lead routing, personalization, ad measurement, retargeting, cross-device linking, audience creation, campaign optimization, and other commercial purposes. These technologies may operate across our Platform, third-party sites, apps, emails, SMS, and other channels, and may continue after you leave the Platform. We may use first-party and third-party analytics and advertising tools, including tools that collect browsing behavior over time and across different websites, devices, or services.

Blocking cookies may limit functionality, but will not necessarily disable all tracking, especially where browser-based or device-level identifiers remain available.

6. Purposes for Processing Information

Subject to applicable law, we may process information for any lawful purpose, including to:

  1. operate, maintain, secure, improve, and monetize the Platform;
  2. provide marketplace functionality, lead routing, matching, scoring, prioritization, bidding, fulfillment, and reporting;
  3. identify, verify, qualify, segment, pre-screen, rank, or profile you for one or more offers, products, services, or providers;
  4. connect or attempt to connect you with one or more Solution Providers, Connectors, affiliates, partners, or other third parties;
  5. enable Marketplace Owner, Connector, and Solution Providers each to independently contact, solicit, remarket to, profile, analyze, enrich, score, suppress, retarget, license, share, sell, and otherwise use your information for their own internal business purposes and external commercial purposes, to the fullest extent permitted by law;
  6. create, enhance, append, license, share, sell, or otherwise commercialize lead, audience, trend, attribution, and marketing data, including in aggregated, de-identified, pseudonymized, or identified form where permitted by law;
  7. contact you by phone, email, SMS, MMS, ringless voicemail where lawful, direct mail, push notification, or other means, whether by manual, automated, prerecorded, AI-assisted, bot-assisted, or artificial means where lawful or consented;
  8. send you offers relating to the products or services you requested and other products or services that may interest you;
  9. conduct analytics, modeling, machine learning, business intelligence, forecasting, attribution, optimization, and product development;
  10. detect fraud, abuse, duplicate leads, invalid traffic, policy violations, security incidents, or unlawful conduct;
  11. enforce our rights, agreements, and policies;
  12. comply with law, regulation, court order, subpoena, law-enforcement request, or internal governance obligations; and
  13. facilitate mergers, acquisitions, financings, restructurings, asset sales, or other corporate transactions.

7. How We Share, Sell, License, and Disclose Information

To the fullest extent permitted by law, we may disclose information about you to any of the following, for any lawful purpose consistent with this Policy:

  1. Connector;
  2. Solution Providers;
  3. Marketplace Owner affiliates, subsidiaries, parents, related entities, successors, and assigns;
  4. advertising networks, analytics providers, cloud vendors, CRM vendors, call center vendors, AI communication vendors, bot vendors, data enrichment providers, fraud vendors, payment processors, communications providers, and other service providers or contractors;
  5. strategic partners, co-marketing partners, referral partners, distributors, list managers, media buyers, lead buyers, lead sellers, data cooperatives, and other commercial counterparties;
  6. legal, accounting, financing, insurance, and other professional advisors;
  7. regulators, courts, law enforcement, and parties involved in legal process;
  8. prospective or actual purchasers, investors, lenders, counterparties, or their advisors in connection with a business transaction; and
  9. any other party with your consent, at your direction, or as otherwise permitted by law.

Without limiting the foregoing, you expressly acknowledge that:

  1. information you submit in connection with a request for products or services may be distributed to multiple Solution Providers, Connector, and other partners, whether simultaneously or sequentially;
  2. once shared, your information may be subject to the recipient’s own privacy practices, and we are not responsible for a recipient’s independent processing except as required by law;
  3. Marketplace Owner, Connector, and Solution Providers may each receive compensation in connection with your data, inquiry, lead, referral, application, click, call, message, appointment, or transaction;
  4. Marketplace Owner, Connector, and Solution Providers may each combine your information with information from other individuals for commercial analytics, benchmarking, modeling, audience building, prospecting, retargeting, and product or business development;
  5. where legally permitted, Marketplace Owner, Connector, and Solution Providers may each sell or share personal information for cross-context behavioral advertising, lead generation, data licensing, or other valuable consideration; and
  6. we may disclose de-identified, aggregated, statistical, or anonymous information without restriction to the extent allowed by law.

8. Consent to Contact; TCPA, SMS, AI, and Bot Communications

By submitting your information through the Platform, you expressly request and consent, to the maximum extent permitted by law, to be contacted by Marketplace Owner, Connector, any applicable Solution Provider, and each of their affiliates, partners, agents, service providers, successors, and assigns, regarding your inquiry and related or potentially relevant products and services.

Such contact may occur via telephone, mobile phone, email, SMS/MMS text message, automatic telephone dialing system, artificial or prerecorded voice, ringless voicemail where lawful, chatbot, conversational bot, virtual agent, AI agent, AI-assisted messaging system, AI-generated voice, AI-generated text, or other automated, semi-automated, or manual communication technology, even if your number is listed on any state, federal, or corporate do-not-call list, subject always to your rights under applicable law. You expressly consent to the use of bots, artificial intelligence systems, generative AI systems, and automated decisioning or routing tools for marketing, follow-up, lead qualification, scheduling, customer service, and communications concerning your inquiry and related offerings, to the extent permitted by law.

Your consent is not a condition of purchase where prohibited by law. You understand that message frequency may vary, that message and data rates may apply, and that consent may be withdrawn as required by law, including by following applicable opt-out instructions such as replying STOP to text messages where supported.

9. Independent Status of Solution Providers and Connectors

Connector and Solution Providers are generally independent businesses and not employees, agents, fiduciaries, brokers, or representatives of Marketplace Owner, unless expressly stated otherwise in a separate writing. We do not guarantee their licensing, qualifications, pricing, performance, availability, compliance, or outcomes. They are solely responsible for their own products, services, communications, representations, and legal compliance.

10. Data Retention

We may retain information for as long as reasonably useful or necessary for the purposes described in this Policy, including for lead monetization, analytics, suppression lists, dispute resolution, contract enforcement, fraud prevention, legal compliance, recordkeeping, backup, archival, and business continuity purposes. Retention periods may differ by stakeholder, data type, legal requirement, and business need.

11. Security

We use commercially reasonable administrative, technical, and organizational measures intended to protect information. However, no transmission, storage system, website, or data processing environment is completely secure. We do not guarantee absolute security and disclaim liability for unauthorized access, interception, loss, misuse, or alteration except to the extent liability cannot be disclaimed under applicable law.

12. Your Rights and Choices

Depending on where you reside, you may have rights such as the right to know, access, delete, correct, limit use of sensitive personal information, opt out of certain sales or sharing, appeal a denial, or request portability. These rights are subject to identity verification, legal exceptions, and stakeholder-specific responsibilities.

Where a particular Connector or Solution Provider independently controls your data, you may need to direct your request to that party. We may forward requests to relevant parties or deny requests we are not legally obligated or technically able to fulfill.

13. State Privacy Addendum

For residents of states with applicable privacy laws, we may collect, use, disclose, sell, or share categories of personal information as described in this Policy for business purposes and, where permitted, commercial purposes. We do not offer rights beyond those required by applicable law.

If a state law permits a business purpose, commercial purpose, or other exception, this Policy shall be interpreted to take full advantage of that permission.

Nothing in this Policy shall be construed to:

  1. waive rights or obligations that cannot be waived under applicable law;
  2. limit any exception, exemption, defense, or safe harbor available to us; or
  3. require us to provide a right, notice, consent mechanism, or technical functionality not required by applicable law.

14. Children

The Platform is not directed to children under 18. We do not knowingly seek to collect personal information directly from children under 18 except as lawfully provided by a parent, guardian, or authorized representative in connection with services. If you believe a child has provided information improperly, contact us.

15. Cross-Border Transfers

If you access the Platform from outside the United States, your information may be transferred to, stored in, and processed in the United States and other jurisdictions that may have different data protection laws than your jurisdiction.

16. Third-Party Sites and Services

The Platform may link to third-party sites, tools, forms, widgets, scheduling systems, payment processors, intake portals, or other services. We are not responsible for those third parties’ content, security, or privacy practices. Your use of third-party services is subject to their terms and policies.

17. Changes to This Policy

We may amend this Policy at any time in our sole discretion. Changes become effective upon posting or upon any later effective date stated in the revised Policy. Your continued use of the Platform after the effective date constitutes acceptance of the revised Policy.
